Procedures
One-Stop Centre (OSC)
With effect from 1 August 2005, employers can complete the application
process for foreign workers at the Home Ministry’s One-stop Centre (Foreign
Workers Division, Level 4, Block 2G4, Precinct 2, 62550 Putrajaya. Tel:
03-8880 1305). Under the new system, officers from the various ministries
would be assigned to the OSC where they process the applications
immediately. Immigration Department will only have to deal with the granting
of visas.
Procedures of Applying for Foreign Workers
Ø
Employers submit application with supporting documents to Home
Ministry
Ø
OSC assesses, interview and decides on the application
Ø
Levy is paid to Home Ministry based on the number of workers
approved @ RM1,200 per worker
Ø
Approval letter is issued
Ø
Employers source for workers themselves or through agents.
They have one year duration to bring in the approved number of workers
Ø
Employers apply to immigration for visa
Ø
Visa is issued to workers upon their arrival at entry points
Ø
Foreign workers to undergo medical check-up within 30 days
upon arrival at any clinics registered under Fomena Sdn. Bhd.
Ø
Once the medical result is transmitted to the Immigration
Department, work permit could then be applied for the workers.
Replacement of workers should also be made at OSC and would be treated as
fresh application where the above procedures apply.
Nationality of Foreign Workers
Under the new ruling, the Ministry of Home Affairs has given approval for
the manufacturing sector to recruit foreign workers from the following
countries of origin: Indonesia (female), Nepal, Pakistan, Cambodia, Laos,
Thailand, Myanmar, Turkmenistan, Kazakhstan, Uzbekistan, Vietnam and
Philippines (male) and Sri Lanka.
Job Clearing System
The Job clearing System is a computer based service to assist employers to
source for local workers. It can be accessed online
http://www.mohr.gov.my/jcs. Before submitting of foreign workers
application form, the employers have to prove that they have tried to look
for local workers through the online system or in person at any Labour
Office. The Labour Office will issue a Letter of Registration
Acknowledgement (Surat Perakuan Pendaftaran JCS) after 30 days or when they
are convinced that local workers are unavailable to fill the vacancies.
Eligibility for Manufacturing Sector
For the manufacturing sector, companies eligible to apply for foreign
workers must meet the following requirements :-
1. Export Orientated Companies - Export value of RM50
million; or
- at least 50% of
export business and To comply with at least one of the following conditions :
I. At
least 40% local content; or
II.
At least 30% added value; or
III.
Capital Investment Ratio Per Employee (CIPE) at least RM100,000
Ratio of local workers to foreign
workers is 1 : 3
2. For Non-export Companies - Paid-up capital not less than
RM100,000; and
- Sales
value at least RM2 million; and-
To comply with at least one of the following conditions : i. At least 40% local content; or ii. At least 30% added
value
Ratio of local workers to foreign workers is 1 : 1
